Copyright and Terms

Peterson's is dedicated to bringing you the best available test preparation product. In order to do so, we must ask that you review and comply with this agreement. This agreement constitutes a formal agreement between the end user ("you") and Peterson's, a Nelnet Company ("Peterson's").

Important: Peterson's is willing to allow you to use the Peterson's Test Prep product (the "Product") only if you accept the terms and conditions in this agreement. By indicating that you accept the terms of this agreement on the registration page, you acknowledge that you have read the terms and conditions of this agreement and agree to comply with them completely.

Contract:

1. License: By accepting this agreement, you certify that you have been designated an Authorized User of this Product by an Authorized Signer of the Peterson's Product Licensing Agreement. You agree that you will keep your Password confidential, and you will not share your Password or allow any third party to access this Product using your Password.

2. Term of License: You are authorized to use this Product only until the expiration or termination of Peterson's Product Licensing Agreement with the party that designated you an Authorized User. Peterson's reserves the right to discontinue your access to this Product in the event that you violate any of the terms and conditions hereunder.

3. Copyright and Proprietary Rights: Peterson's owns all right, title and interest in and to this Product, including, without limitation, all content, component parts and user interface incorporated in this Product, and you shall not take any action inconsistent with such ownership. This Product is protected by United States, Canadian and other applicable copyright laws and by international treaty provisions. Therefore, you may not reproduce, copy, broadcast, publicly perform or display, network, modify, enhance, supplement, create derivative works from, adapt, translate, disassemble, alter, decompile, reverse engineer or otherwise reduce this Product to human readable form, in whole or in part. Peterson's and its licensors retain all rights not expressly granted to you in this agreement.

4. Disclaimer and Limitation of Liability: This Product, and any materials and services provided by Peterson's in connection therewith are provided "as is," without warranty of any kind. Peterson's expressly disclaims all warranties, express and implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Peterson's does not warrant that the operation of this Product will be uninterrupted or error-free. In no event will Peterson's be liable for damages of any kind, arising out of, or in any way connected with, this Product, even if Peterson's has been advised of the possibility of such damages.

Privacy and Security: Peterson's agrees that all personal data provided by you as part of your use of the Program will be kept entirely confidential and will not be shared with third parties. Peterson's may contact you directly in response to your request for assistance, or in connection with your use of the Product or participation in Peterson's program. Notwithstanding the foregoing, you agree that Peterson's may use and disclose data on our Authorized Users' course usage, test performance, and survey responses provided such data is disclosed only in an aggregate form, without including any individually identifiable information.
